Taxpayers often are subject to tax audits and other agency actions taken by the IRS. The notice of an audit can cause understandable concern. Mistakes and findings of wrongdoing can lead to tax penalties and criminal charges. However, even the IRS recognizes that taxpayers have rights under the law.

The IRS recently released a publication that discusses the IRS Taxpayer bill of Rights. This publication contains 10 categories of rights taxpayers have when interacting with the IRS. The publication also notes that the IRS has a continuing obligation to protect the rights of taxpayers.

Probably most important among these rights include the right to be informed regarding any IRS determinations that impact you. This includes receiving understandable explanations concerning tax laws and IRS procedures.

The IRS notice also explains that you as the taxpayer have a right to receive professional assistance from employees and agents of the IRS. You have the right to challenge IRS actions, and also have the right to appeal an IRS determination in court.

Should there be an adverse determination by the IRS, you have the right to know the deadlines for challenging the IRS position. You also have the right to know when the conclusion of an audit takes place. Under this bill of rights, no IRS inquiry should be more intrusive than necessary. And all of your tax information should remain confidential.

As we have said many times on this blog, you always will have the right to legal representation in any dealing with the IRS. And the IRS must consider the facts of your situation before making a determination.
